Abstract

Music and copyright in the age of Internet

Some recent technological innovations connected with the affirmation of the digital format and the advent of telecommunication networks have influenced and orientated the most recent tendencies in the consumption of music; in fact, alongside the traditional phonographic supports new methods of digital distribution via Internet are now firmly established. Important consequences have arisen in the overall juridical system protecting copyright in connection with these changes in the utilization of music. This article examines – from the point of view of the user – some legal aspects typical of music consumption via the Internet network in the light of the recent evolution of Italian, European and international jurisprudence and of the opinions expressed during a recent lively theoretical debate on the subject.
Furthermore, the paper discusses the principal technical and juridical features connected with the file-sharing arrangement and the most recent services introduced in the lawful digital music market.
